Wrongful Death:  In some cases in which a relative of yours has died as a result of an incident or some one's negligence, you may have significant rights as a survivor to that deceased relative.  Even though we must all take time to mourn the passing of our loved ones, it is critical to procure a competent legal analysis as early as possible.  Under the right circumstances, a survivor can obtain a settlement and/or insurance benefits to cover funeral expenses, hospital and medical bills, and even damages for the loss of their relationship with the deceased.  The following are few examples of wrongful death claims:

  • Motor Vehicle Accidents:  If your loved one passes away as the result of a motor vehicle accident, then you may have claims against the owners and drivers of the motor vehicles involved in the accident.
  • Medical MalpracticeIf a medical provider's negligent treatement resulted in your loved one's death, then you may have claims against any or all of the involved doctors, nurses and/or hospitals.
  • Recalled Products:  If any form of product on the market results in or contributes to a loved one's death, then you may have a claim against the manufacturer and/or distributor of that product.

Survivor's Rights & Loss of Consortium:  In most cases the legal "Survivors" of a deceased person are the spouse and children; however other dependents and relatives may have claims as well.   Survivors can recover damages for the loss of their personal relationship and quality of life with the deceased individual.

Funeral Expenses & Medical Bills:  One of your more immediate economic concerns after the passing of a loved one will likely be the resulting funeral expenses and medical bills.  Under the right circumstances, all of these expenses and bills can be covered by the party responsible for causing your loved one's death.
